As the event organizer, I agree that if the event I wish to coordinate is approved by UPMC Children’s Hospital Foundation (“The Foundation”), I agree to abide by the Guidelines for Community Fundraisers.
THE EVENT ORGANIZER AGREES TO ASSUME ALL RISKS AND LIABILITIES ASSOCIATED WITH THE EVENT AND HEREBY RELEASES AND HOLDS UPMC CHILDREN’S HOSPITAL FOUNDATION AND ITS DIRECTORS, OFFICERS, EMPOYEES, AGENTS, SUCCESSORS, AND ASSIGNS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES ARISING OUT OF OR WHICH MAY OCCUR IN CONJUNCTION WITH THE EVENT, INCLUDING, WITHOUT LIMITATION, ANY PERSONAL INJURIES OR DAMAGE TO PROPERTY WHICH MAY OCCUR IN CONJUNCTION WITH THE EVENT.
It is also agreed that the funds raised from the activity will support current established charitable purposes at the Foundation and will be remitted to the Foundation within 60 days of the event or otherwise upon mutually agreeable terms within alternative terms mutually agreed. All funds donated via the community fundraising website will be dispersed directly to the Foundation and may not be used for expenses incurred by the event or to support an organization other than the Foundation.
By using this Website to raise contributions in your own name, or in honor or memory of the Honoree, you agree that you have discussed with the Honoree’s family or legal representative, your intentions to raise money for the Foundation in that individual’s name or memory, and the Honoree, or Honoree’s family or legal representative, approves of this endeavor. You shall defend, indemnify, and hold the Foundation and its corporate affiliates and their respective officers, directors, employees, contractors, agents, successors and assigns harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable attorneys’ fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your importing of any content to this Website, any third party claims of infringement or any breach of these Website Terms of Use, and in particular disclosing personal and/or medical information of the Honoree on the Personal Fundraising Webpage.
By using the Foundation’s community fundraising website, I represent, on my behalf and on behalf of others who I authorize to post content on the applicable activity page, that we are solely responsible for the content posted on the website including but not limited to photos, text, videos, graphics, personal profiles and protected health information and that no such content will be libelous, defamatory or inappropriate in any manner and that we have obtained all necessary authorizations. Information, ideas or opinions posted by users of the website do not necessarily reflect the views of the Foundation and the Foundation does not take any responsibility for the accuracy of any information, ideas or opinions posted by users. The Foundation shall not be liable for any damages or losses resulting from such information, ideas or opinions. As a user, you understand and agree that the Foundation may terminate any fundraising event or user access to use the site at any time and for any reason. By posting any information or other content on the website, you have authorized the Foundation to publish such materials in any manner desired without any obligation to compensate you or anyone else.
Images on givetochildrens.org fundraising webpages and email templates can be used only within givetochildrens.org and only for the purpose of fundraising for UPMC Children’s Hospital Foundation. Downloading, modifying, displaying, sharing, and any other use of these images outside of givetochildrens.org is prohibited.
You further understand and agree that the Foundation may monitor and delete any content that we, in our sole and absolute discretion, believe violates the terms of this user agreement or which may be illegal or offensive or inappropriate, or which poses a threat to the rights or safety of the Foundation users.
